TERMS & CONDITIONS

Lifting Gear AU is pleased to offer you the opportunity to buy and receive goods and services (“Products”) through the Lifting Gear website based on the following terms:

Orders

In respect of each Product listed in your Checkout Summary, your order is an offer from you to Lifting Gear to buy that Product from us. We will be bound to supply you the Product once payment has been processed and we have sent you an email order confirmation. All accepted orders supersede all previous quotes or estimates.

Information About Products

Due to screen limitations and image quality associated with the representation of Products, some goods may differ to a slight extent in visual appearance (e.g., in colour) from the way they appear on the website.

Pricing & Payment

You must pay for all online purchases at the time of online checkout prior to order confirmation in accordance with one of the payment methods offered on the Website. Where we cannot fulfil an order, a refund will be provided.

The prices of Products, and any delivery or other charges, shown are in Australian dollars, inclusive of GST.

Delivery

Where the Product is being delivered, delivery options are listed on each Product Page. Available delivery options, terms and charges for each Product will be shown on the relevant Product Page. The option selected by you and the applicable estimated delivery times will be shown in your Checkout Summary.

Lifting Gear will use reasonable endeavours to deliver Products within the time frame shown. You will be notified via email once your Products have been dispatched.

Lifting Gear is not liable for delay in delivering goods which is beyond their reasonable control (e.g., if stock is unavailable). If the Product has not been delivered within a reasonable time, please contact us.

You must ensure there is clear and safe access for delivery. Please ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, Lifting Gear will endeavour to deliver the Product if safe and appropriate to do so.

Some Products may require extra delivery personnel which may incur an additional charge as advised to you before you submit your order.

Warranties & Liability

All Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Products may contain warranty documents on or inside the packaging provided by the manufacturer or distributor. Unless clearly expressed otherwise, any such warranty is not given by Lifting Gear.

All other warranties and representations are excluded, except those which are non‑excludable in law. Subject to the Australian Consumer Law, where Products supplied are not of a kind ordinarily acquired for personal, domestic or household use, Lifting Gear’s liability is limited to refunding the price, replacing or repairing the relevant goods (at Lifting Gear’s option).

To assist Lifting Gear in resolving any problems, please inspect the goods upon delivery and report any shortage, discrepancy, defect, wrong specification or similar issue as soon as you become aware of it.

Cancellation by Lifting Gear

Lifting Gear may cancel any order (in full or part) where: (i) you are in breach of payment obligations; (ii) Lifting Gear reasonably suspects you are purchasing goods for resale; (iii) the goods are out of stock; (iv) there has been a genuine pricing or product description error; or (v) the transaction is suspected of credit card or payment‑related fraud.

Lifting Gear will refund any amount already paid in respect of any cancelled order. In the case of part cancellation, a refund will be provided for the cancelled portion.

Privacy

Lifting Gear collects your personal information to allow us to supply you with lifting and rigging products. By placing an order through this Website, you consent to Lifting Gear collecting your personal information (including your name, contact details and delivery address) and providing it to third parties (such as suppliers and delivery contractors) for the purpose of fulfilling and delivering your order.

Refunds & Returns

While we don’t offer change‑of‑mind returns or exchanges, we will accept product returns and provide a replacement, refund or repair where:

  • The product is faulty or not of acceptable quality;
  • The product is not fit for its intended purpose;
  • The product does not match its sample or description.

This does not apply to manufactured and special‑order goods which are not returnable unless a warranty is breached.

The product must be unused and returned in the original, undamaged packaging.

We recommend you retain your receipt, as proof of purchase may be required. Receipts and tax invoices must be valid and intact.

All refunds will be provided back in the original tender.
